When seriously ill patients reach the end of the standard treatment trajectory for their condition, they may qualify for the use of unapproved, investigational drugs regulated via expanded access programs. In medical-ethical discourse, it is often argued that expanded access to investigational drugs raises ‘false hope’ among patients and is therefore undesirable. We set out to investigate what is meant by the false hope argument in this discourse. In this paper, we identify and analyze five versions of the false hope (...) argument which we call: (1) the limited chance at benefit argument, (2) the side effects outweighing benefits argument, (3) the opportunity costs argument, (4) the impossibility of making informed decisions argument, and (5) the difficulty of gaining access argument. We argue that the majority of these five versions do not provide normative ground for disqualifying patients’ hopes as false. Only when hope is rooted in a mistaken belief, for example, about the likelihood of benefits or chances on medical risks, or when hope is directed at something that cannot possibly be obtained, should it be considered false. If patients are adequately informed about their odds of obtaining medical benefit, however small, and about the risks associated with an investigational treatment, it is unjustified to consider patients’ hopes to be false, and hence, to deny them access to investigational drug based on that argument. This study employed a scenario-based approach whereby participants were asked to choose which communication channel they prefer in certain situations. The first aim was to determine the effect of the topic of interactions and social ties on channel choice. The second aim was to examine the underlying mechanisms in the relation between interaction topic and social ties and channel choice. A questionnaire was administered among 238 participants, who were presented five communication scenarios with topics of low and high intimacy and (...) four social ties, ranging from weak to strong. Results revealed that preference for face-to-face communication was highest, followed by audio-only computer-mediated communication and text-based CMC. Preference for FtF communication was higher when people valued feeling co-present and decreased when people valued feeling anonymous. Our results showed that communication channel choice is strategic and the choice for FtF ommunication, audio-only and text-based CMC largely depends on controllability, anonymity and co-presence. Drawing on ethical and legal frameworks in the Netherlands, the United States and France, we examine whether physicians are expected to inform patients about potentially relevant opportunities for expanded access to investigational drugs. While we found no definitive legal obligation, we argue that physicians have a moral obligation to discuss opportunities for expanded access with patients who have run out of treatment options to prevent inequality, to promote autonomy, and to achieve beneficence.

The progressive dominance of historical-critical methods in the reading of ancient Chinese classics has led scholars to privilege micro levels of textual analysis. Consequently, the question as to whether laws of composition could be identified in this corpus has often been ignored, or considered irrelevant. Working on Chinese number symbolism as well as on rules governing “ring composition” in other cultural contexts, this article aims at fashioning anew the question of the possibility of an ancient Chinese “structural rhetoric” and at (...) envisioning the patterns that might have governed it. It specifically applies the approach it propounds to Huainanzi 淮南子, showing how numerology frames its structure and argument, the text being built after the image of the “roundness” of the Way and of the Ruler. It then endeavors to apply these results to the unearthing of “inter-structural” patterns that would help us to locate Huainanzi, Lüshi Chunqiu 呂氏春秋, the versions at hand of Zhuangzi 莊子, Lunyu 論語, or yet Laozi 老子 into a textual universe that shares correlated rhetorical features. The last sentence of Chapter 10 of the Analects describes a brief encounter between Confucius and a hen-pheasant, and it does so in puzzling terms, ridden with lexical difficulties. At the same time, intertextual references insert this fragment into the context of Confucius’ life mission as well as of Chinese mythological narratives. This contribution assesses the fragment’s meaning and significance: Confucius’ reaction to the hen-pheasant unveils his evolving understanding of the Heavenly Mandate bestowed upon him. The fragment thus forcefully concludes (...) the chapter in which it is inserted. Additionally, I put forward a hypothesis: the focus of this narrative, coupled with its positioning at the end of Chapter 10, induce us to postulate that it may have been purposefully located at the very center of the Analects, a proposition that reverberates on the way we look at the composition of the book. The present article discusses remarks and suggestions made by Andrew Meyer and Dennis Schilling on a previous contribution of the author. It assesses the status of the root-branches analogy in the Huainanzi 淮南子, and the compatibility of the said analogy with the composition of the same work as a ring composition. It also discusses the numerology proper to the Huainanzi in view of the principles provided by the Yijing 易經. It compares the structural arrangements of the Huainanzi with the ones (...) found in the various versions of the Daodejing 道德經. It concludes on the relationship that these two works establish between the understanding the Way (dao 道) and knowledge about shapes and numbers. (shrink)

This book revisits the encounter between Chinese and Western philosophy while unfolding questions about the way "comparative philosophy" is conducted today. In the vulgate of intellectual history, "Western thought" has constructed a substantialist view of reality that puts "relations" and "processes" into a subordinate position. The same view explains for the primacy given to the autonomy of individual beings. In contrast, according to the same vulgate, Chinese thought has been mainly stressing the fluidity of all phenomena and forms of life (...) so as to best adapt to their overarching patterns. I label such vision the Disneyland of comparative philosophy. It deciphers texts, partly in function of concepts that it extracts from them, partly according to notions that are superimposed over these texts. The two first chapters are focused upon the Western version of the "Disneyland of comparative philosophy." The third chapter shifts to Chinese narratives about local, comparative and global philosophies. In contrast to these approaches, the fourth chapter offers a blueprint as to the way to engage different philosophical traditions into tasks they define and share together. A last chapter presents four cases of ongoing transcultural philosophical dialogues and the promises they bear. Once it develops outside pre-formatted narratives, the web shaped by our philosophies and wisdoms suggests the outlines of a world that we could inhabit together. (shrink)

Throughout the manuscript of the Pensées and in other writings, Pascal crisscrosses his research on what the art of writing achieves and entails, on the one hand, and on the way to read and interpret the Holy Scriptures, on the other hand. Reading and writing practices are critically interwoven. This article offers a synthesis on Pascal’s reflexive account of such practices. After a summary of previous findings on the subject, it examines Pascal’s approach to (a) the rules that govern scriptural (...) interpretation; (b) the techniques of persuasion; and (c) the way to ground an instituted body, an expression by which we refer to a textual corpus, a political society, or a community of believers. For the theorists of crisis, the revolutionary state comes into existence through violence, and due to its inability to provide an authoritative katechon (restrainer) against internal and external violence, it perpetuates violence until it self-destructs. Writing during extreme economic depression and growing social and political violence, the crisis theorists––Joseph de Maistre, Juan Donoso Cortés, and Carl Schmitt––each sought to blame the chaos of their time upon the Janus-faced postrevolutionary ideals of liberalism and socialism by urging a return to pre-revolutionary moral (...) and religious values. They are united by three counterrevolutionary principles, all of which are purported to remedy revolutionary violence: traditional constitutional fidelity, the philosophy of the decision, and opposition to bourgeois liberalism. This essay is followed by the first complete English translation and publication of Donoso’s letter of October 24, 1851, which contains Donoso’s only reference to the “discussing class,” a political entity later popularized by Schmitt in his 1922 work Political Theology. Via a hermeneutics focused on Chinese numerology and concentric arrangements, the book offers a novel construal of the textual universe proper to early China writings. The author lays bare distinguishable patterns of textual composition while relating them to corresponding patterns of thinking. He differentiates rhetorical variants through detailed studies of the Zhuangzi's Inner chapters, the Laozi, the Analects, and the Huainanzi. The philosophical depth and relevance of the Chinese ancient worldview appear in a fresh light when one unearths the patterns (...) into which its content is embedded. The focus on textual patterns and rhetorical arrangements also facilitates the reading of Chinese classics alongside other traditions. In much of the current academic and public discussion, conspiracy theories are portrayed as a negative phenomenon, linked to misinformation, mistrust in experts and institutions, and political propaganda. Rather surprisingly, however, philosophers working on this topic have been reluctant to incorporate a negatively evaluative aspect when either analyzing or engineering the concept conspiracy theory. In this paper, we present empirical data on the nature of the concept conspiracy theory from five studies designed to test the existence, prevalence and exact form (...) of an evaluative dimension to the ordinary concept conspiracy theory. These results reveal that, while there is a descriptive concept of conspiracy theory, the predominant use of conspiracy theory is deeply evaluative, encoding information about epistemic deficiency and often also derogatory and disparaging information. On the basis of these results, we present a new strategy for engineering conspiracy theory to promote theoretical investigations and institutional discussions of this phenomenon. We argue for engineering conspiracy theory to encode an epistemic evaluation, and to introduce a descriptive expression—such as ‘conspiratorial explanation’—to refer to the purely descriptive concept conspiracy theory. This paper examines the two main motifs in the Συναξάριον τοῦ τιμη- μένου γαδάρου and the Γαδάρου, λύκου κι ἀλουποῦς διήγησις ὡραία: the Ass’s Confession and the Mule’s Hoof, tracing them back to Medieval western rather than Ancient Aesopic sources. Arguably no concept is more fundamental to science than that of causality, for investigations into cases of existence, persistence, and change in the natural world are largely investigations into the causes of these phenomena. Yet the metaphysics and epistemology of causality remain unclear. For example, the ontological categories of the causal relata have been taken to be objects (Hume 1739), events (Davidson 1967), properties (Armstrong 1978), processes (Salmon 1984), variables (Hitchcock 1993), and facts (Mellor 1995). (For convenience, causes and effects (...) will usually be understood as events in what follows.) Complicating matters, causal relations may be singular (Socrates’s drinking hemlock caused Socrates’s death) or general (Drinking hemlock causes death); hence the relata might be tokens (e.g., instances of properties) or types (e.g., types of events) of the category in question. Other questions up for grabs are: Are singular causes metaphysically and/or epistemologically prior to general causes or vice versa (or neither)? What grounds the intuitive asymmetry of the causal relation? Are macro-causal relations reducible to micro-causal relations? And perhaps most importantly: Are causal facts (e.g., the holding of causal relations) reducible to non-causal facts (e.g., the holding of certain spatiotemporal relations)? (shrink)

The topic of professionalism has dominated the content of major academic medicine publications during the past decade and continues to do so. The message of this current wave of professionalism is that medical educators need to be more attentive to the moral sensibilities of trainees, to their interpersonal and affective dimensions, and to their social conscience, all to the end of skilled, humanistic physicians. Urgent calls to address professionalism from such groups as the Association of American Medical Colleges, the American (...) Board of Internal Medicine, and the Accreditation Council for Graduate Medical Education, among others. In fact, at the 2004 annual meeting of the AAMC six separate presentations addressed professionalism with such titles as "Evaluating Humanism and Professionalism," Professionalism: Expectation, Education, Evaluation," or "Toward Assessing Professional Behaviors of Medical Students through Peer Observations". Professionalism, then, has become part of the current academic medicine parlance, used by administrators, clinical faculty, residency programs, and professional organizations with an expectation of shared meanings and goals. All of these stakeholders focus on what has become a consistent list of attributes deemed to be the essence of professionalism, which usually include variations on altruism, duty, excellence, honor and integrity, accountability, and respect. In fact, most of the scholarly work to date has been listing, describing, decrying, and measuring/evaluating it. In this collection of essays, we don’t argue with these attributes. Instead, we ask questions of the discourse from which they arise, how the specialized language of academic medicine disciplines has defined, organized, contained, and made seemingly immutable a group of attitudes, values, and behaviors subsumed under the label "professional" or "professionalism." This collection aims to be a critical text, one that questions the profession’s beliefs about the nature of its work and how such beliefs are enacted in medical education, particularly as they fuel the professionalism discourse. In addition, we will scrutinize how the discourse is enacted in both the formal and hidden curriculum, and in the larger medical environment. (shrink)

This volume provides a philosophical introduction to and analysis of the study of metaphor. By proceeding from the concrete analysis of complex metaphors, White is able to identify a range of features which are incompatible with standard accounts of the way words function in metaphor.

Some theories of goodness are descriptively rich: they have much to say about what makes things good. Neo-Aristotelian accounts, for instance, detail the various features that make a human being, a dog, a bee good relative to facts about those forms of life. Famously, such theories of relative goodness tend to be comparatively poor: they have little or nothing to say about what makes one kind of being better than another kind. Other theories of goodness—those that take there to be (...) absolute goodness—are comparatively rich: they offer grounds for judging some types of things better than others because they have more absolute goodness. Moorean accounts, for example, can tell us that humans and human experiences are superior to bees and blades of grass. But such theories tend to be descriptively poor: they struggle to tell us in virtue of what this is so. In this essay we motivate and flesh out a view that splits the difference between accounts of goodness as relative and accounts of goodness as absolute. Such a view holds promise only if the mechanics of this kind of metaphysics of goodness can be worked out. Here we present a view on which the paradigm for absolute goodness is God and the paradigm for each kind of relative goodness is a divine idea. (shrink)
